Two layers of rights
In the Netherlands, copyright covers the composition and lyrics; neighbouring rights cover the performance and the recording. A chart track therefore involves several rightsholders: writer, publisher, artist, label. You cannot drop it into a podcast without permission, not even a short underbed.

What platforms expect
Spotify, Apple Podcasts, YouTube and other hosts assume you cleared music. Automated content ID on video can mute or block episodes when recognisable commercial music appears. That includes brief stingers or background from a personal playlist.
Log music per episode: title, artist, licence or contract. Keep receipts or emails from royalty-free libraries at least as long as the episode stays online.
Royalty-free is not rights-free
Royalty-free usually means one licence fee instead of per-play royalties. It is not permission for every use. Check each track for podcast, social clips and sponsored reads, and whether credit lines are mandatory.
Free loops bundled with a DAW may be personal-use only. Read the EULA before you export a master. When unsure, pick explicit podcast licences or commission music with written assignment of use.
Collective management in the Netherlands
Buma/Stemra often manages authors’ and publishers’ rights for music exploited in public in the Netherlands. Sena collects for performers and producers on recordings. Public podcasts with commercial chart music without a licence clash with these systems quickly.
Corporate shows with office-playlist beds are risky: a streaming subscription does not cover commercial distribution. Internal-only listening may differ; involve HR or legal when staff listen at work.
Guests, samples and live music
If a guest sings a cover or brings a beat, you remain responsible for what stays in the edit. Ask upfront: do you own this, may we publish it? Clearing samples from old records is slow; do not plan on a studio-day fix.
Live music in the room can sound great, but publication rules are the same. Note who played and under which agreement. We help with balance; contracts stay outside the session.
How we work in session
Thijs Hofman coordinates podcast sessions at Ocularniva with fixed table mics and headphones. Mention in your booking request whether intro, outro or transitions are ready and under which licence. That avoids losing post time to replace illegal beds.
We store recordings 9 months per our privacy policy. That is not publicity consent for guests — use a release when topics are sensitive.
Safer routes
- Commission a jingle with written podcast and clip rights.
- Use a stock library with an explicit podcast licence and saved invoice.
- Only use music you wrote and performed, or received in writing.
- Skip commercial releases under dialogue unless a licence is on file.
- Keep a cue sheet per episode for your team.
Budget and next steps
Music licences range from a few euros per stock track to bespoke composer deals. Keep that separate from studio time: €155 covers room, engineer and rough edit, not chart rights. Need more time? €78 per extra hour.
